1. General provisions

 

  1. The website www.happyclothes.eu operates on the terms set out in these Regulations.
  2. The Regulations define the types and scope of services provided electronically by the Website www.happyclothes.eu, the rules for the provision of these services, the conditions for concluding and terminating agreements for the provision of electronic services, as well as the complaint procedure.
  3.   4. Each Customer, upon taking steps to use the Electronic Services of the Website www.happyclothes.eu, is obliged to comply with the provisions of these Regulations.
  5. In matters not covered by these Regulations, the following provisions shall apply:

    ○ The Act on Providing Services by Electronic Means of July 18, 2002 (Journal of laws, No. 144, item 1204 as amended),

    ○ The Act on consumer rights of May 30, 2014 (Journal of laws of 2014, item 827),

    ○ The Civil Code Act of April 23, 1964 (Journal of laws No. 16, item 93, as amended) and other generally applicable provisions of Polish law.

 

2. Definitions

 

  1. CONTACT FORM - a form available on the Website www.happyclothes.eu enabling the Customer to contact the Service Provider directly.
  2. REGULATIONS - these Website regulations.
  3. SERVICE PROVIDER - Monir Al-Obaidi conducting business activity under the name Happy Clothes Monir Al-Obaidi, registered office address: Odzieżowa 6, 71-502 Szczecin, address for service: Odzieżowa 6, 71-502 Szczecin, NIP (Taxpayer Identification Number): 9552198051, REGON (National Business Registry Number): 320361180, entered into the Central Register and Information on Economic Activity, e-mail address: office@happyclothes.eu, phone: +48883915860.
  4. CUSTOMER - a natural person, legal person or an organizational unit without legal personality, to which the law grants legal capacity using the Electronic Service.
  5. ELECTRONIC SERVICE - a service provided electronically by the Service Provider to the Customer via the Website.
  6. NEWSLETTER - Electronic Service allowing the Customer to subscribe and receive free information from the Service Provider to the e-mail address provided by the Customer.

 

 

 

 

3. Type and scope of electronic services

 

  1. The Service Provider enables the use of Electronic Services via the Website, such as: using the Contact Form, using the Newsletter,
  2. The provision of Electronic Services to the Customers takes place under the conditions specified in the Regulations.

 

4. Terms and conditions for the provision and conclusion of electronic services agreements

 

  1. Provision of Electronic Services specified in Chapter 3 point 1 of the Regulations by the Service Provider is free of charge.
  2. The period for which the agreement is concluded:

 

  1. the agreement for the provision of Electronic Services consisting in enabling the sending of a message via the Contact Form is concluded for a definite period of time and is terminated when the message is sent or the Customer ceases to send it.
  2. The agreement for the provision of Electronic Services consisting in the use of the Newsletter is concluded for an indefinite period.
  3. Technical requirements necessary for cooperation with the ICT system used by the Service Provider:

 

  1. a computer with Internet access,
  2. access to e-mail,
  3. web browser,
  4. enabling cookies and Javascript in the web browser.

 

  1. The Customer is obliged to use the Website in a manner consistent with the law and morality with respect for personal rights and intellectual property rights of third parties.
  2. The Customer is obliged to enter data consistent with the actual state.
  3. The Customer is prohibited from providing illegal content.

 

5. Terms and conditions for terminating electronic services agreements

 

  1. Termination of the agreement for the provision of Electronic Services:
  2. The agreement for the provision of Electronic Services of a continuous and indefinite nature may be terminated (e.g. using the Newsletter).

    2.The Customer may terminate the agreement with immediate effect and without giving reasons by sending an appropriate statement via e-mail to the following address: office@happyclothes.eu

  1. The Service Provider may terminate the agreement for the provision of Electronic Services of a continuous and indefinite nature in the event that the Customer violates the Regulations, in particular when the Customer provides unlawful content after an ineffective prior call to cease such violations with an appropriate deadline. In that case, the agreement expires after 7 days from the date of submitting the declaration of will to terminate it (notice period).
  2. Termination leads to cessation of the legal relationship with effect for the future. The Service Provider and the Customer may terminate the agreement for the provision of Electronic Services at any time by mutual agreement.

 

6. Complaints procedure

 

  1. Complaints related to the provision of Electronic Services by the Service Provider:

 

    1.Complaints related to the provision of Electronic Services via the Website may be submitted by the Customer via e-mail to the following address: office@happyclothes.eu

  1. In the above e-mail, please provide as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of occurrence of irregularities as well as contact details. The information provided will significantly facilitate and accelerate the consideration of the complaint by the Service Provider.
  2. Consideration of the complaint by the Service Provider takes place immediately, not later than within 14 days.
  3. The Service Provider's response to the complaint is sent to the Customer's e-mail address provided in the complaint or in a different manner provided by the Customer.

 

7. Intellectual property

 

  1. All content posted on the website at www.happyclothes.eu is protected by copyright and is the property of www.happyclothes.eu.The Customer is fully responsible for damage caused to the Service Provider, resulting from the use of any content on the website www.happyclothes.eu, without the Service Provider's consent.
  2. Any use by anyone, without the express written consent of the Service Provider, of any of the elements constituting the content of the website www.happyclothes.eu constitutes a violation of the Service Provider's copyright and results in civil and criminal liability.

 

8. Final Provisions

 

  1. Agreements concluded via the Website are concluded in accordance with Polish law. In the event of non-compliance of any part of the Regulations with the applicable law, in place of a disputed provision of the Regulations, the relevant provisions of Polish law shall apply.
